TERMS & CONDITIONS OF SERVICE

These Terms & Conditions form the agreement between Quick Response Manchester Ltd trading as Quick
Drains Manchester (“the Company”) and the customer (“the Customer”) relating to all drainage, tanker,
waste removal, inspection, repair, maintenance, and associated services carried out by the Company.
By requesting attendance, accepting a quotation, booking services, or allowing works to commence, the
Customer confirms acceptance of these Terms & Conditions in full.
All prices are subject to VAT at the prevailing rate unless otherwise stated.
1. Responsibility for Payment
The person, company, tenant, landlord, managing agent, or third party instructing or authorising the works
shall remain fully liable for payment of all charges incurred.
The instructing party confirms they are authorised to request the works and accept responsibility for
payment regardless of:
• Ownership disputes
• Tenancy disputes
• Insurance claims
• Utility company involvement
• Third-party reimbursement arrangements
Payment disputes between tenants, landlords, agents, insurers, utility companies, or third parties do not
affect the Customer’s obligation to pay the Company’s invoices in full.
2. Access, Site Preparation & Utilities
The Customer is responsible for ensuring safe and suitable access is available prior to attendance.
The Customer must ensure:
• Clear and unobstructed working areas
• Safe access to drainage systems, inspection chambers, septic tanks, and treatment plants
• Adequate vehicle access and manoeuvring space
• Access to water and electricity where required
• Accurate site information including drainage layouts, tank locations, and known hazards where
available
The Customer shall ensure the site is suitable for HGV, jet-vac, tanker, and specialist drainage vehicles
including sufficient:
• Width clearance
• Height clearance
• Weight-bearing ground conditions
• Hard standing access where required
The Company accepts no liability for damage caused by vehicle movement on surfaces deemed unsuitable,
weak, unstable, restricted, or improperly disclosed by the Customer.
Where access is unavailable, unsafe, obstructed, or unsuitable, the Company reserves the right to:
• Abort attendance
• Suspend works
• Re-schedule works
• Re-quote works
• Apply waiting charges
• Apply failed attendance charges
The Customer remains liable for all charges incurred where attendance cannot proceed due to site
conditions or inaccurate information provided at booking.
3. Safety, Compliance & Commercial Sites
For commercial, industrial, construction, or controlled sites, the Customer is responsible for ensuring
compliance with all relevant health and safety requirements including:
• CDM Regulations
• Site induction procedures
• Permit systems
• Confined space regulations
• Welfare arrangements
• Method statement requirements
• Safe systems of work
Where additional compliance procedures, inductions, permits, escorts, delays, or waiting time are
required, additional charges may apply.
The Company reserves the right to refuse or suspend works where safe working conditions are not
provided.
4. Drain Clearance & Repeat Blockages
Drain clearance services are provided on the basis of attempting to restore flow within accessible drainage
systems.
The Company cannot guarantee permanent clearance where underlying defects or recurring issues exist
including:
• Structural defects
• Root ingress
• Collapsed drains
• Grease or scale build-up
• Foreign objects
• Existing damage
• Shared drainage issues
• Public sewer issues
Where drains are cleared without CCTV inspection or further investigation, the Company cannot guarantee
the blockage will not reoccur.
If a blockage reoccurs within 7 days, the Company reserves the right to recommend CCTV inspection or
further investigation prior to carrying out additional works.
Any return visits, investigations, CCTV surveys, or additional works remain chargeable unless expressly
agreed otherwise in writing.
5. CCTV Surveys & Investigations
CCTV inspections and reports reflect the visible condition of the drainage system at the time of inspection
only.
Surveys are limited to drainage systems capable of accepting CCTV equipment.
The Company accepts no liability for:
• Hidden defects
• Concealed damage
• Inaccessible pipework
• Defects not visible during inspection
• Subsequent failures occurring after inspection
Photographs, videos, CCTV footage, and recordings may be taken for operational, evidential, insurance,
training, reporting, or legal purposes.
6. Septic Tank Emptying & Vacuum Tanker Services
Quoted tanker pricing applies to standard domestic sewage waste only unless otherwise agreed in writing.
Additional charges may apply for:
• Excessive solids or sludge
• Fats, oils, and grease
• Chemicals or hazardous materials
• Contaminated waste
• Difficult extraction conditions
• Additional loads
• Extended hose requirements
• Specialist disposal requirements
Waste sampling and laboratory testing may be required before removal of certain waste types.
The Customer is responsible for accurately describing waste contents prior to attendance.
The Company reserves the right to refuse removal of waste deemed unsafe, hazardous, contaminated, or
improperly described.
Waste disposal charges are based upon waste classification at the time of disposal and any additional
disposal costs incurred due to contamination or misdescription shall be chargeable to the Customer.
Where waste has been removed from site, disposal charges, tanker charges, and waste handling charges
remain payable regardless of subsequent payment disputes or refusal to pay.
7. Scope of Work & Additional Charges
All quotations and pricing are based upon the information provided by the Customer at the time of
booking.
Should the scope of works differ from the original description, the Company reserves the right to:
• Revise pricing
• Apply additional labour charges
• Apply specialist equipment charges
• Apply disposal charges
• Re-quote the works
Additional works identified during attendance remain chargeable unless expressly agreed otherwise in
writing.
8. Utility Company & Third-Party Issues
Where investigations determine the issue relates to a utility provider, public sewer, water authority, or
third-party infrastructure, all attendance, labour, investigations, equipment usage, and services carried out
up to that point remain fully chargeable.
The Customer remains liable for all charges regardless of whether additional works are subsequently
undertaken by a utility company or third party.
9. Waiting Time, Delays & Abortive Visits
Quoted pricing assumes works can proceed without interruption or delay.
The Company reserves the right to apply waiting charges where delays occur due to:
• Restricted access
• Site conditions
• Waiting for Customer instruction
• Third-party contractors
• Utility companies
• Delays outside of the Company’s control
Abortive visit charges may apply where:
• Access is unavailable
• The site is unsafe
• Utilities are unavailable
• The Customer is absent
• The drainage system is inaccessible
• Vehicles cannot safely access the site
Waiting charges may apply per engineer and per vehicle in attendance.
10. Excavation, Repairs & Reinstatement
Excavation and repair works may reveal additional defects or unforeseen conditions not visible prior to
commencement.
Where further works are identified, the Company reserves the right to:
• Pause works
• Re-quote the works
• Charge for additional labour, materials, reinstatement, plant hire, disposal costs, or specialist
equipment
All reinstatement works are carried out to a reasonable standard unless otherwise agreed in writing.
11. Pre-Existing Condition & Damage Waiver
Drainage systems are often aged, defective, damaged, poorly maintained, or structurally compromised
prior to attendance.
The Customer acknowledges that the use of drainage equipment including:
• High-pressure water jetting
• Mechanical cleaning equipment
• Root cutting equipment
• CCTV equipment
• Vacuum extraction equipment
may expose or reveal pre-existing defects, collapses, fractures, leaks, displaced joints, or structural failures
that were not previously visible.
The Company accepts no liability for:
• Pre-existing defects
• Structural failures
• Pipe collapses
• Leaks
• Drainage failures
• Weak pipework
• Defects revealed during the course of the works
12. Site Damage Disclaimer
The Company shall not be liable for damage to:
• Surfaces
• Driveways
• Landscaping
• Ground conditions
• Lawns
• Paving
• Underground services
• Delicate finishes
where such damage results from:
• Necessary access requirements
• Existing site conditions
• Heavy vehicle movement

• Excavation works
• Restricted working areas
• Unsafe or unsuitable access routes
The Customer accepts that drainage and excavation works are inherently disruptive in nature.
13. Defects Liability & Right To Inspect
In the event the Customer alleges defective workmanship, service failure, or incomplete works, the
Company must first be given reasonable opportunity to inspect the alleged issue and, where appropriate,
rectify the works.
The Customer must not instruct third-party contractors to carry out remedial works without first providing
the Company reasonable opportunity to inspect and respond.
The Company shall not be liable for:
• Third-party contractor costs
• Alternative contractor invoices
• Additional repair costs
• Consequential losses
where the Customer has failed to provide the Company reasonable opportunity to inspect or rectify the
alleged issue.
14. Payment Terms
Unless otherwise agreed in writing, payment is due immediately upon completion and before departure
from site.
The Company accepts:
• Debit Card
• Credit Card
• Bank Transfer
Credit facilities are available to approved account holders only.
Late payments shall incur:
• Statutory interest pursuant to the Late Payment of Commercial Debts legislation where applicable
• Debt recovery compensation fees
• Collection costs
• Legal fees
• Court fees
• Administrative recovery charges
Failure to make payment may result in recovery action or legal proceedings without further notice.
The Company reserves the right to suspend future services and withhold reports, recordings, CCTV
footage, warranties, or documentation until payment has been received in full.
15. Limitation of Liability
The Company shall not be liable for:
• Pre-existing defects
• Structural drainage failures
• Consequential losses
• Loss of business or income
• Hidden defects
• Delays outside of the Company’s control
• Recurring blockages
• Damage caused by defective or collapsed drainage systems
The Company’s total liability shall not exceed the value of the services supplied.
16. Cancellations
Bookings cancelled within 24 hours of the scheduled attendance may incur cancellation charges.
Where specialist vehicles, tankers, engineers, or equipment have already been dispatched, additional
charges may apply.
17. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England
and Wales.
18. Acceptance
By accepting a quotation, requesting attendance, booking works, or allowing works to commence, the
Customer confirms acceptance of these Terms & Conditions in full.
